Terms and Conditions

By participating in the  ‘Blue Creator Fund Competition’ (the “Competition”), each entrant is deemed to have accepted these terms and conditions. Entrants must comply with these terms in full to be eligible to win the Prize.  The Foundation reserves the right to refuse entry to, void the entry of, refuse to award a prize to or withdraw a prize awarded to, any entrant who breaches any of these terms.

Entry Requirements
(a) The Competition is open to everyone in the Territory (as defined below) who fulfils the Eligibility Criteria (as defined below). In order to enter the Competition, entrants must submit an application form setting out a vision for a project centered around Chelsea FC and the community (either using words or submitting a video) (an “Application”).

(b) Each entrant must submit their Application to the Foundation using the online Competition form on the following website: www.bluecreatorfund.com. All fields in the entry form must be completed. The Foundation does not accept Applications submitted via mail, email, direct message or by any other means of communication.

Prize
(a) Funding of up to £20,000 (to be awarded at the Foundation’s sole discretion) to create a piece of content centred around Chelsea FC and the community (the “Project”).

(b) Access to mentors and workshop with Creative Director.

(c) Each Winner’s Project will be shared across VERSUS and the Foundation’s social media (such publicity to be determined by VERSUS and the Foundation (as applicable) at their sole discretion).

(d) Each Winner’s Project will be displayed in a weekend exhibition at the  Saatchi Gallery, London in March 2025.

1. THE COMPETITION AND ELIGIBILITY

1.1. The Competition is being run and administered by the Foundation. Entrants can contact the Foundation about the Competition by emailing the Foundation Contact.

1.2. The Competition is open to anyone in the United Kingdom (the “Territory”) who fulfils the following criteria:

(a) is aged 18 – 30 (inclusive) or over;

(b) is not an employee of the Foundation, Chelsea Football Club PLC (the “Club”) and its and their group companies, anyone professionally connected with the competition or a member of their respective immediate families; and

(c) is from background which is underrepresented in the creative sector (as determined at the Foundation’s sole discretion), (together the “Eligibility Criteria”).

1.3. The Competition will be open for the duration of the Competition Period. Applications received by the Foundation outside of the Competition Period will not be eligible to win a Prize.

1.4. No purchase is required to participate in the Competition, however entrants will need an internet connection. No refund may be claimed for expenses incurred in participating in the Competition, including in relation to the use of the Internet.

1.5. Each entrant confirms that their Application will be an original work which they have not copied from another work.

1.6. Entrants who choose to submit a video as part of their Application must ensure the video does not contain any hateful, racist, sexually explicit, obscene, violent or other objectionable or inappropriate content (as determined by the Foundation in its sole discretion).

1.7. Upon submitting an entry to the Competition, each entrant grants to the Foundation and third parties engaged by or associated with the Foundation, including sponsors, partners, suppliers and influencers (together the “Third Parties”) a royalty-free, worldwide, irrevocable right to use, copy, alter and display the entry:

(a) in any and all media throughout the world, including (without limitation) in printed publications and promotional materials;

(b) in the advertising of the goods and services of the Foundation and any applicable Third Parties; and

(c) on the website(s) and other digital platforms (including social media channels) of the Foundation and any applicable Third Parties.

1.8. Each entrant warrants and represents that:

(a) it has and shall continue to hold any applicable approvals, licences, permissions and consents necessary in order to grant the Foundation and all applicable Third Parties the rights under paragraph 1.7 above; and

(b) its entry, and the use of its entry by the Foundation’s and any applicable Third Parties, shall not infringe the rights, including the intellectual property rights, of any third party.


2. ENTRY TO THE COMPETITION

2.1. To enter the Competition, entrants must carry out the Entry Requirements.

2.2. Entrants may only participate in the Competition once. Duplicate entries will be void and only the first entry submitted will be eligible to win a Prize. 

2.3. The Foundation reserves the right, at any time, to:

(a) verify the eligibility of any participant (including their age and place of residence); and

(b) exclude anyone who the Foundation believes to have acted in breach of these terms from participating in the Competition.

2.4. The Foundation shall not be responsible for any attempt to participate in the Competition which is unsuccessful or incomplete for any reason, including because of communication or network failures.


3. THE WINNERS

3.1. At the end of the Competition Period, the Foundation will select, in accordance with paragraphs 3.2 – 3.7, the winning entries as the Winners. The number of winning entries shall be the Number of Winners.

First round of judging

3.2. The Applications of eligible entrants will be judged by between 5-10 judges from the Foundation, Chelsea Football Club, VERSUS and mentors, based on the criteria described in the competition entry page. 5-10 applicants will be selected to participate in the second round of judging. The decision of the panel of judges (acting reasonably) during the first round of judging will be final.

3.3. The Foundation will send the full names of the judges to anyone who writes within one month after the End Date of the Competition, to request this please contact the Foundation Contact.

3.4. The successful entrants from the first round of judging will be contacted by the Foundation in the week commencing 1 July 2024 (using the information submitted as part of their entry). The successful entrants shall have two days to confirm their availability to attend the second round of judging. In the event that a successful applicant cannot be contacted within two days of the Foundation’s first attempt to contact them, or cannot attend the second round of judging, a replacement entrant may be selected in accordance with paragraph 3.2.

Second round of judging

3.5. Successful applicants will be required to attend a second round of judging of in the week commencing 8 July 2024 at Stamford Bridge, Fulham Road, London, Greater London, SW6 1HS. The second round of judging can take place virtually at the successful applicants request.

3.6. Successful applicants will be judged by between 5-10 judges from the Foundation, Chelsea Football Club, VERSUS and mentors. The second round of judging will consist of an interview where the successful applicants will be required to discuss their vision for their Project, expanding on responses given in the Application.

3.7. The Winners will be contacted by the Foundation within 5 days following the date the second round of judging is held (using the information submitted as part of their entry). The Winner(s) shall have two days to confirm their acceptance of the Prize. In the event that a Winner cannot be contacted within two days of the Foundation’s first attempt to contact them, or chooses not to redeem the Prize, a replacement Winner from the successful applicants may be selected.

3.8. The Foundation is under an obligation to publish or make available information that indicates that a valid prize award took place. As such, the Foundation will send the surname, county (if applicable) and a copy of their entry (if applicable) of the Winner(s) to anyone who contacts the Foundation Contact within one month of the closing date of the Competition requesting details of the Winner(s).

3.9. If any entrant objects to the information described in paragraph 3.8 being made available, they may contact the Foundation Contact to object. This will not affect the entrant’s chances of winning the Prize. In such circumstances, the Competition must still provide that entrant’s information to the Advertising Standards Authority on request.


4. THE PRIZE

4.1. The Winners will each receive the Prize subject to the Winner entering into a separate agreement with the Foundation in relation to the release of funding.

4.2. The Prize may not be substituted or exchanged. Where the Prize is subsequently not available for any reason beyond the Foundation's control, the Foundation may replace the Prize with a prize of similar value.

4.3. The Winner(s) shall be solely responsible for all taxes, and the reporting consequences thereof, and for any other fees or costs associated with the applicable prize. If any taxes or fees are levied against the Foundation in respect of the Prize, the Foundation may recover those taxes, costs and/or fees from the Winner and the Winner agrees to reimburse the Foundation such taxes, costs and/or fees.

4.4. The Prize will only be awarded to the Winner(s). Under no circumstances may the Prize be sold or transferred, for cash or otherwise.

4.5. The Winner's attendance at any venue(s) not owned or controlled by the Foundation and/or Chelsea Football Club are subject to that venue’s rules and regulations, which may include the right to refuse admission or eject any person at the venue’s discretion.

4.6. The Foundation assumes no responsibility for and accepts no liability regarding any aspects of the Prize that are not under the control of, or are not fulfilled by, the Foundation (including any non-fulfilment of such aspects of the Prize).


5. LIABILITY

5.1. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW THE FOUNDATION EXCLUDES LIABILITY FOR ANY LOSSES, DAMAGES AND CLAIMS INCURRED BY ANY PERSON IN CONNECTION WITH THE COMPETITION. THE FOUNDATION IS NOT RESPONSIBLE FOR ANY DELAYED, LOST OR INCOMPLETE ENTRIES.

5.2. THE COMPETITON IS NOT IN ANY WAY SPONSORED, ENDORSED OR ADMINISTERED BY, OR ASSOCIATED WITH FACEBOOK OR TWITTER AND EACH ENTRANT ACKNOWLEDGES AND AGREES THAT NEITHER FACEBOOK NOR TWITTER SHALL HAVE ANY LIABILITY IN CONNECTION WITH THE PROMOTION.


6. DATA PROTECTION AND PUBLICITY

6.1. The Foundation will use personal information (which may include, with your consent special categories of personal data such as race or ethnicity, sexual orientation or health data) of entrants to the Competition:

(a) to administer and operate the Competition (including as described in paragraph 4.8); and

(b) in respect of the name, image, social media handles of Winners, for reasonable promotional purposes,
and otherwise in accordance with its privacy policy. Please read the privacy policy for more information about how the Foundation uses personal information.


7. GENERAL

7.1. All decisions made by the Foundation in respect of the Competition shall be final and no correspondence will be entered into.

7.2. The Foundation reserves the right to amend these terms and conditions, any Prize and/or cancel the Competition at any time as a result of circumstances beyond its control.

7.3. If any provision of these terms and conditions shall be found by any court or administrative body of competent jurisdiction to be invalid or unenforceable, such invalidity or unenforceability shall not affect the other provisions of these terms and conditions, and all provisions not affected by such invalidity or unenforceability shall remain in full force and effect.

7.4. THIS COMPETITION, AND ANY DISPUTE OR CLAIM ARISING OUT OF OR IN CONNECTION WITH IT, SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH ENGLISH LAW.  EACH ENTRANT AGREES THAT THE COURTS OF ENGLAND AND WALES SHALL HAVE NON-EXCLUSIVE JURISDICTION TO SETTLE ANY DISPUTE OR CLAIM THAT ARISES OUT OF OR IN CONNECTION WITH THIS COMPETITION.
